Plain-English summary — the short version
  • Upstar is a booking platform. The people who show up — crew, LLC partners, and specialists — are independent contractors and partner businesses, not Upstar employees.
  • Your card is only held at booking and charged after the job is completed — never before.
  • Cancel 24+ hours ahead and it's free. Cancelling late or not providing access may result in a fee of up to 50% (full amount for no-access).
  • Monthly plans bill monthly (or annually if you choose that option) — cancel anytime with 30 days' notice, and a skipped visit is rescheduled or credited, never just lost.
  • Damage? Tell us within 24 hours and we'll help make it right.
  • We only collect worker location at clock-in/out for mileage pay — never continuous tracking.

1. Who we are

Upstar Services LLC ("Upstar," "we," "us") is a Missouri-based marketplace and booking platform headquartered in Kansas City, MO. Upstar connects customers with independent service providers — crew members, LLC partner businesses, and independent specialists — for home, yard, and auto services throughout the Kansas City metro area.

By booking a service, applying to provide services, or otherwise using upstarservices.com (the "Platform"), you agree to these Terms of Service ("Terms"). If you don't agree, please don't use the Platform.

2. We're a marketplace, not an employer

Upstar acts as a booking agent and marketplace connecting customers with service providers. Services are performed by independent contractors and partner businesses — not by employees of Upstar. Upstar does not supervise the day-to-day means or methods of the work performed and is not a party to the underlying service relationship in the way a traditional employer would be. Providers are responsible for the quality, timing, and manner of the work they deliver, subject to the standards described in these Terms.

3. Booking & payment

When you book a service, your payment card is authorized (a "hold") for the estimated price — you are not charged at this time. Your card is only charged once your service has been completed.

If the scope of a job turns out to be different than what was booked (for example, a yard is larger than described), our crew may propose a price adjustment. Nothing changes without your approval — we'll send you an approval link, and you can approve the new total or decline and keep the original price and scope.

4. Monthly Plans

Recurring service plans bill monthly, or annually where you select the annual billing option. You can cancel your plan anytime with 30 days' notice. If you need to skip a scheduled visit, we'll reschedule it or credit it toward a future visit — a skipped visit is never simply forfeited. Your plan pricing is locked in for as long as your plan stays active.

If you believe damage occurred during a service, please report it to us within 24 hours of the service being completed. We'll work with you and the provider to coordinate an inspection and resolution. Claims reported after this window may be more difficult for us to verify and resolve.

7. Reviews

We welcome honest reviews of your experience. Reviews should reflect your genuine opinion of the service received. Fake, incentivized, or fraudulent reviews are not permitted and may be removed.

8. Service area

Upstar currently serves the Kansas City metro area, including Kansas City, Independence, Lee's Summit, Blue Springs, Overland Park, Olathe, Liberty, and surrounding cities. Availability may vary by neighborhood and service type.

9. For providers — crew, LLC partners & specialists

These provisions apply if you work with Upstar as a crew member, LLC partner business, or independent specialist (together, "Providers").

Independent contractor relationship

You provide services as an independent contractor or independent partner business, not as an employee, agent, or joint venturer of Upstar. You control the means and methods by which you perform your work, including how you complete a job, subject to reasonable quality and safety standards and the specific scope requested by the customer.

Insurance & licenses

Where your trade requires a license, permit, or insurance under Missouri law or local ordinance, obtaining and maintaining that license, permit, or insurance is your responsibility, not Upstar's.

Payment terms

Location data

If you're a crew member using the Upstar worker app, we collect your GPS location only at clock-in and clock-out, solely to calculate mileage for pay. We do not track your location continuously or while you're off the clock.

Photo uploads & license to display

If you upload photos to your specialist or provider profile (work samples, portfolio images, profile photo), you grant Upstar a license to display those photos publicly on the Platform as part of your profile, so customers can see your work before booking.

Ending your participation

Either you or Upstar may end your participation on the Platform at any time, for any lawful reason, with reasonable notice where practical.

10. Limitation of liability

To the extent permitted by applicable law, Upstar's liability arising out of or related to your use of the Platform is limited, and Upstar is not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits liability that cannot be limited under Missouri law.

11. Governing law

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-laws principles.

12. Changes to these Terms

We may update these Terms from time to time as our services evolve. We'll update the "Last updated" date above when we do. Continued use of the Platform after changes means you accept the updated Terms.
